These Terms and Conditions ("Terms"), together with our Privacy Policy and any other policy or notice we publish on the Website, form the agreement between you and us. "You" means any person who visits or uses the Website.
The Website presents information about our agricultural inputs, including bio-fertilisers, seeds and crop protection products, and lets you get in touch with us. These Terms are an electronic record under the Information Technology Act, 2000 and the rules made under it. They are valid without any physical or digital signature.
2. Acceptance and eligibility
By accessing or using the Website you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not use the Website.
To submit information to us, make an enquiry or place an order, you must be at least 18 years old and capable of entering into a binding contract under the Indian Contract Act, 1872. If you use the Website on behalf of a farm, business, cooperative or other organisation, you confirm that you are authorised to bind it to these Terms.
The Website is meant for use in India. We do not promise that its content or our products are available or suitable outside India. If you use the Website from another country, you are responsible for following the local laws there.
3. Changes to the Website and these Terms
We may change, suspend or withdraw any part of the Website, including its content and the products shown, at any time and without notice, for maintenance, legal, regulatory or business reasons.

- 4.6reverse engineer, decompile or try to obtain the source code of any part of the Website;
- 4.7use our name, brand or content to mislead others, for example by making false claims about a product or passing off another product as ours; or
- 4.8use the Website to send unsolicited commercial messages.
5. Product information and regulatory compliance
The Website and the product catalogue we make available on it describe our range of fertilisers, seeds and crop protection products for general information only. They are not an offer capable of acceptance. Product names, descriptions, specifications, images, packaging and availability may vary and may change without notice. Any pack size or price shown is indicative.
Our products are regulated under Indian law, including, as applicable to each product, the Insecticides Act, 1968 and the Insecticides Rules, 1971, the Fertiliser (Control) Order, 1985 and the Seeds Act, 1966. Some products may be sold only through licensed dealers, and some may be sold or used only in certain states or for certain crops.
The label, leaflet and packaging on the product you receive are the authoritative source for its composition, registration details, dosage, crop and method of application, precautions and first aid. If anything on the Website differs from the label or leaflet, the label and leaflet prevail.
6. Agronomic guidance and responsible use
Information on the Website about yield, soil health, pest and disease control, sustainability and farmer experiences, including testimonials and videos, is general in nature. It is not personalised agronomic, technical or professional advice. Crop results depend on many factors outside our control, such as soil, weather, seed variety, water, crop stage, pest pressure and farm practice. We do not guarantee any particular yield, income or pest or disease control result.
You must:
- 6.1read the label and leaflet and follow the recommended dose, timing, crop and method of application;
- 6.2observe all safety precautions, waiting periods and protective equipment guidance;
- 6.3store products in their original containers, away from food, feed, water and children;
- 6.4seek medical help at once in case of suspected poisoning and show the label to the doctor; and
- 6.5consult your local agriculture department, Krishi Vigyan Kendra or a qualified agronomist for crop-specific advice, and check that a product is permitted for your crop and state before you use it.
7. Enquiries, orders, pricing and payment
At present the Website is informational and does not process online orders or online payments. Contacting us through the Website, by phone or by email is an enquiry, not an order.
Orders for our products are placed with us or with our authorised dealers and distributors. An order is binding only when we or the dealer confirm it in writing, for example by an order confirmation or invoice. The price, applicable taxes (including GST), delivery, payment, replacement and other commercial terms for a sale are set out in the quotation, order confirmation or invoice, which apply together with these Terms. Prices exclude taxes unless stated otherwise.
Before we open a trade account, we ask business buyers for know-your-customer (KYC) documents, as described in our Privacy Policy. The documents you give us must be complete, genuine and up to date. We may decline, delay or suspend supply if documents are missing, or if we find that they are false or out of date.
We may decline or cancel an order for reasons such as stock availability, a pricing or description error, a regulatory restriction on selling the product in your state, or suspected fraud.

If we introduce online ordering in future, additional terms, including the price, cancellation, return and refund terms required by the Consumer Protection (E-Commerce) Rules, 2020, will apply and will be shown to you before you place an order.
8. Dealers, distributors and third-party sellers
Our products may be sold through independent dealers, distributors and retailers. They are independent businesses, not our agents unless we say so in writing, and they are free to set their own selling prices as permitted by law. We are not responsible for their acts or omissions, except where the law makes us responsible for the products we manufacture or supply.
We recommend that you buy only from licensed sellers, ask for a proper bill or invoice, and check that the pack is sealed and the label is intact.
9. Testimonials, videos and submitted content
Testimonials and videos on the Website, including videos embedded from YouTube, show the personal experiences and opinions of the people featured. Results vary from farm to farm, and these testimonials are not a promise that you will get the same results.
If you send us any content, such as a message, feedback, photograph or video, you confirm that you own it or have the right to share it and that it does not infringe anyone's rights or break any law. You allow us to use it to respond to you and to handle your enquiry. We will ask for your separate written consent before we publish your name, photograph, video or testimonial in our marketing.
We may remove any content that breaches these Terms or the law.
10. Intellectual property
The Website and everything on it, including text, graphics, logos, images, videos, the product catalogue, page layout and software, belongs to us or our licensors and is protected under Indian law, including the Copyright Act, 1957 and the Trade Marks Act, 1999. "Nukrishi", "Nuzen Agrigenetics" and our related names and logos are our marks, whether or not registered.
We give you a limited, non-exclusive, non-transferable and revocable licence to view the Website and to download or print the product catalogue for your personal, non-commercial use, including when you are deciding whether to buy from us. You may not copy, reproduce, modify, distribute, publish, frame or create derivative works from any part of the Website, or use our marks, without our prior written consent. Marks of third parties belong to their owners.

11. Third-party links and embedded content

14. Limitation of liability
To the maximum extent the law allows, we and our directors, officers, employees and agents are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, income, crop, revenue, data or goodwill, arising from your use of the Website, your inability to use it, or your reliance on its content. Our total liability to you for any claim relating to your use of the Website is limited to ₹10,000.
Nothing in these Terms limits or excludes liability for fraud, for death or personal injury caused by negligence, for product liability under the Consumer Protection Act, 2019, or for any other liability that cannot be limited or excluded by law. Liability for the products you buy is governed by your invoice or order confirmation and by applicable law, not by this clause.
15. Indemnity
You agree to indemnify us and our directors, officers and employees against claims, losses, damages and reasonable legal costs that arise from your breach of these Terms or of applicable law, or from content you submit that infringes the rights of a third party.
16. Suspension and termination
We may suspend or block your access to the Website at any time, without notice, if we reasonably believe that you have breached these Terms or the law, or if this is needed to protect the Website or other people. Clauses that by their nature should continue after termination, including those on intellectual property, disclaimers, limitation of liability, indemnity and governing law, will continue.
17. Force majeure
We are not liable for any delay or failure to perform that is caused by events beyond our reasonable control. These include natural disasters, floods, drought, unusual weather or crop conditions, epidemics, war, riots, strikes, government orders or regulatory restrictions (including a ban or restriction on a product), power or internet failure, and failure of third-party suppliers or carriers.
18. Governing law and dispute resolution
These Terms, and any dispute arising out of or in connection with them, are governed by the laws of India.
If a dispute arises, please first write to our Grievance Officer (clause 19) with the details, and we will try in good faith to resolve it amicably. A dispute that is not resolved within 30 days of your written notice will be referred to a sole arbitrator appointed by mutual consent, under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration will be Jaipur, Rajasthan, and the language will be English. Subject to this, the courts at Jaipur, Rajasthan have exclusive jurisdiction.
If you are a consumer, this clause does not stop you from approaching a Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019, or any other forum that the law gives you.

20. General provisions
- 20.1Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us about your use of the Website. For the sale of goods, the invoice or order confirmation also applies, and prevails on commercial terms if it conflicts with these Terms.
- 20.2Severability: if any part of these Terms is held invalid or unenforceable, the rest continues in force.
- 20.3No waiver: if we do not enforce a right, that is not a waiver of it.
- 20.4Assignment: we may assign these Terms to an affiliate or a successor to our business. You may not assign them without our written consent.
